Who you are dealing with
This site is operated by LithoPoint, a sole proprietorship operated by Mike Leonardo in the Commonwealth of Kentucky, United States ("LithoPoint", "we", "us"). By using this site you agree to what follows. If you do not, please stop using it.
What this site is
lithopoint.com is an informational site about the company and the software it makes. Nothing on it is an offer, a contract, a warranty, or professional advice of any kind. We describe software that is still in development, and descriptions of unreleased software are statements of intent rather than promises about what will ship, when, or at what price.
Our software is licensed separately
These terms cover this website. Every LithoPoint software product is governed by its own end-user licence agreement, presented when you install or buy it. Where that licence and this page disagree about the software, the licence wins.
What belongs to whom
The content of this site — its text, its layout, the LithoPoint name and the arch mark — belongs to LithoPoint. You may link to this site freely and quote briefly from it with attribution. You may not pass off our name or mark as your own, or present a modified copy of this site as ours.
Other product names, logos and brands mentioned here belong to their respective owners. LithoPoint and its software are independent and are not affiliated with or endorsed by any of them.
Links out
Where this site links somewhere else, we are not responsible for what you find there. A link is not an endorsement.
No warranty, and the limit of what we owe
This site is provided as it is, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise the site will be available without interruption or free of error.
To the fullest extent the law allows, LithoPoint is not liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of this site. Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as that law permits.
Changes
We may revise these terms. The date at the top of this page is when they last changed; continuing to use the site after that is acceptance of the revision.
Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-laws rules.
